Pemanfaatan Marhun Bih oleh Murtahin di Pegadaian Syariah dalam Persfektif Imam Madzhab

Abstract

This study aims to analyze the utilization of marhun bih by murtahin in sharia pawnshops based on the review of Imam Madzhab. This research belongs to the type of qualitative research, the method used in this research is a qualitative research method with a literature study method, namely the data collection method is carried out by analyzing the data by the theme to be discussed and then describing or describing the actuality and accuracy of the data. Rahn aims to provide the party providing the loan can trust the borrower or the debtor. An item that is used as collateral still belongs to the person who pawned the goods or who owes, but is still controlled by the one who gives the receivable or pawn recipient. Based on DSN-MUI Fatwa No.25 / DSN-MUI / III / 2002. states that Rahn is a loan that uses collateral, namely goods in the form of sharia pawn or rahn that it is allowed. There are differences of opinion among madzhab scholars regarding the utilization of marhun which is taken advantage of by harin. Some allow rahin to take advantage of marhun as long as it does not reduce the value of marhun, and some do not allow rahin to take advantage of marhun because it is the right of muratahin.
