Abstract

The Salam contract is one of Abu Hanifah’s economic concepts. Abu Hanifah was born in Kufa, Iraq, in 80 AH or 699 CE, during the caliphate of Abdul Malik bin Marwan. His real name was Nu’man bin Marzuban. He died in Baghdad in 767 AH or 767 CE. The Salam contract can occur in online sales or e-commerce. E-commerce is an abbreviation for electronic commerce, which is essentially a form of business involving multiple parties through a computer network. This study employs a qualitative data analysis method. In today’s era, numerous online transactions are conducted via e-commerce platforms such as Tokopedia, Shopee, Lazada, Bukalapak, and others. The application of the Salam contract will be synchronized through its essential elements: the muslam (seller), the muslam alaih (buyer), the modal (money, also referred to as the price), the muslan fiih (the item being bought and sold), and finally the shighat (ijab qabul). It will also be synchronized with the conditions, namely that payment is made at the place where the contract is concluded, the goods become a liability for the seller, the goods are delivered according to the time specified in the agreement or at the time of the contract, the goods must be clearly defined in terms of measurement—such as weight—etc., the characteristics of the goods to be sold are known and specified, and the location where the goods will be received is specified.
